Welcome to Boone Studios, LLC. By using our websites, software platforms, or services, you agree to the following terms and conditions.

1. General Terms

Plain English: Boone Studios builds software platforms and also offers some computer repair services. These rules apply to everything we provide. If you do not agree, do not use our services.

Legal: Boone Studios, LLC ("Boone Studios," "we," "us," "our") is a U.S.-based software company that develops and provides software platforms, applications, and related digital services. In addition, Boone Studios also provides limited computer repair and technical support services.

These Terms of Service apply to all services, platforms, and products provided by Boone Studios. By accessing or using any of our services, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Software and Digital Services

Plain English: We make software for U.S. users. You are responsible for how you use it and keeping your account/devices safe. We cannot guarantee it will always work without interruption.

Legal:

  1. Software Platforms: Boone Studios provides software solutions and platforms intended primarily for U.S. audiences. Access to and use of these platforms is subject to these Terms of Service.
  2. User Responsibility: You agree to use our software and services in compliance with all applicable U.S. laws and regulations. You are responsible for maintaining the security of your account, devices, and data.
  3. Service Availability: While we strive to provide reliable access, Boone Studios does not guarantee uninterrupted or error-free operation of its software platforms or services.

3. Computer Repair and Technical Services

Plain English: We also do repairs and house calls. You need to cancel at least 24 hours in advance. Back up your own files before service. Some problems take longer to fix than expected.

Legal: Boone Studios also offers in-shop computer repairs, on-site (house call) repairs, and data backup services.

  • House Calls: House call services are available within our defined service radius. Cancellation or rescheduling must be made at least 24 hours before the scheduled appointment.
  • Data Backup: Boone Studios offers secure backup solutions. However, you remain solely responsible for maintaining your own backup copies prior to any service.
  • No Guarantee of Resolution: While we work to resolve issues promptly, certain repairs may require additional time or diagnosis.

4. Product Sales

Plain English: If we sell products or hardware, it is while supplies last, and we can change or stop offering them any time.

Legal: All products and hardware sold by Boone Studios are subject to availability. Boone Studios reserves the right to modify or discontinue products at any time without notice.

5. Payment Terms

Plain English: Payment is due when the service is provided or the product is purchased. For house calls, you pay when the technician arrives.

Legal: Payment is due at the time of purchase or upon completion of service. For house calls, payment is required upon technician arrival. Boone Studios accepts payment via cash and card.

6. Refund Policy

Plain English: All sales are final. We do not do refunds, but if something goes wrong, we will work with you to fix it.

Legal: All sales and services are final. Boone Studios does not provide refunds for software, services, or repairs. If you are unsatisfied with a service, please contact us directly and we will work to resolve the issue.

7. Limitation of Liability

Plain English: We are not responsible for data loss, damage, or downtime. Our services are provided "as is."

Legal: Boone Studios is not responsible for any data loss, hardware damage, software failures, or incidental costs arising from the use of its services or platforms. All services are provided "as is." Boone Studios disclaims liability for indirect, incidental, or consequential damages.

8. Privacy

Plain English: We take your privacy seriously. See our Privacy Policy for details on how we handle your information.

Legal: Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Governing Law and Jurisdiction

Plain English: We are a U.S. company and operate under U.S. law only. If you are outside the U.S. and use our services, you agree that U.S. law applies.

Legal: Boone Studios, LLC is organized and exists under the laws of the United States of America.

Any non-U.S. individual or entity that chooses to access or use Boone Studios services acknowledges and agrees that:

  • They are using services developed and operated by a U.S.-based company.
  • Their use of such services is subject exclusively to the laws and jurisdiction of the United States of America.
  • They waive any claim to the application of foreign laws, regulations, or jurisdiction in relation to such use.

10. Indemnification

Plain English: If your actions with our services cause us legal trouble, you agree to cover our costs.

Legal: You agree to indemnify, defend, and hold harmless Boone Studios, LLC and its officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your use of our services, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution and Arbitration

Plain English: If there is a disagreement, it will be handled through arbitration in Mississippi, not a lawsuit or class action.

Legal: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Hattiesburg, Mississippi, and judgment upon the award rendered may be entered in any court of competent jurisdiction.

You agree that you may bring claims against Boone Studios only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. Severability

Plain English: If one part of these terms is not enforceable, the rest still apply.

Legal: If any provision of these Terms is found unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.

13. Entire Agreement and No Waiver

Plain English: These terms and our Privacy Policy make up the whole agreement. If we do not enforce a rule right away, it does not mean we have waived it.

Legal: These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Boone Studios regarding your use of our services. Any failure by Boone Studios to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

14. Force Majeure

Plain English: We are not responsible if events outside our control (like natural disasters or internet outages) prevent us from providing services.

Legal: Boone Studios shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, internet or telecommunications failures, or governmental actions.

15. Changes to These Terms

Plain English: We can update these terms at any time. If you keep using our services after changes are posted, it means you accept them.

Legal: Boone Studios reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
